SYRACUSE, N.Y. (AP) — The New York State Division of Well being is “exploring its choices” after a state Supreme Courtroom decide struck down a statewide mandate requiring well being care employees to be vaccinated in opposition to COVID-19, the company stated Saturday.
Choose Gerard Neri wrote in a ruling launched Friday that Democratic Gov. Kathy Hochul and the well being division overstepped their authority by mandating a vaccine that is not included in state public well being legislation, the Syracuse Post-Standard reported.
The mandate is “null, void, and of no impact,” the decide stated. He sided with Medical Professionals for Knowledgeable Consent, a bunch of medical employees impacted by the vaccination mandate.
The mandate protects individuals most at-risk for critical signs and the individuals who take care of them, the well being company stated in a press release to The Related Press.
“The requirement is a important public well being software,” the company stated. “The State Well being Division strongly disagrees with the decide’s resolution and is exploring its choices.”
